Acceptable Use Policy

1. About this policy

1.1 This Acceptable Use Policy ("AUP") sets out the rules for using the Plate Circle Platform. It forms part of, and should be read with, our Terms and Conditions and Privacy Policy.

1.2 By using the Platform you agree to this AUP. If you breach it, we may take the action set out in section 8.

2. General

2.1 You must use the Platform lawfully, honestly, and in good faith, and must not use it in any way that harms Plate Circle, other Users, or third parties.

3. Prohibited content

You must not post, list or submit content that:

3.1 is unlawful, fraudulent, defamatory, obscene, threatening, harassing, discriminatory, or otherwise objectionable;

3.2 is false or misleading, including inaccurate Listings, fake offers, or misrepresentations about a Registration or its entitlement;

3.3 infringes any third party's intellectual property, privacy or other rights;

3.4 contains another person's personal data without a lawful basis, or that identifies or targets an individual (including via the Spotted feature, see section 6);

3.5 promotes or describes using a Registration to make a vehicle appear newer than it is, or any other breach of DVLA rules or the law; or

3.6 contains malware, or links intended to harm or deceive.

4. Prohibited conduct

You must not:

4.1 post or accept offers you do not intend to honour, or manipulate prices, valuations or rankings (including "shill" or self-bidding on your own or associated Listings);

4.1A submit frivolous, joke or unrealistic offers, flood a Listing or Seller with excessive or repeated offers, or otherwise abuse the bidding system (see clause 5.6 of the Terms for the fair-use rules and the measures we may apply);

4.2 circumvent the Platform or its fees, including completing or soliciting transactions off-Platform in breach of clause 10 of the Terms (anti-circumvention);

4.3 impersonate any person, or misrepresent your identity, entitlement or affiliation;

4.4 create multiple or fake accounts, or use an account to evade suspension;

4.5 scrape, harvest, crawl, or extract data from the Platform (including Listings, images, valuations and Market Data) except as we expressly permit, or copy, replicate, republish, redistribute, frame, mirror or commercially reuse Platform content, or use it for text/data mining or AI training, in breach of clause 16 of the Terms;

4.6 interfere with, probe, overload, or attempt to gain unauthorised access to the Platform, its security or its infrastructure;

4.7 use the Platform to send spam, or to harass, abuse or threaten other Users; or

4.8 use the Platform for any unlawful purpose, including money laundering, fraud, or handling Registrations you are not entitled to deal in.

5. Listing and selling integrity

5.1 You may only list a Registration you are entitled to sell, and your Listing must be accurate, complete and not misleading.

5.2 You must keep Listings current and withdraw them promptly when a Registration is no longer available.

5.3 Responsibility for entitlement and good title rests with the Seller; misrepresenting either is a serious breach (see Terms clauses 4 and 18).

6. Spotted feature

6.1 You may only submit images to Spotted that you took yourself or have the right to submit.

6.2 Spotted is for vehicles and registration marks visible in public, or content used with permission. You must not:

• (a) post personal information about another person, or content that identifies or could identify a vehicle's keeper or owner;
• (b) include identifiable people, faces, or property in a way that reveals where someone lives or works;
• (c) use the feature to harass, shame, track, "dox" or target anyone; or
• (d) post location data that exposes where a person or vehicle is regularly kept.

6.3 Full Spotted terms are in clause 14 of the Terms. Report content you believe breaches this AUP to support@platecircle.com.

7. Reporting violations

7.1 If you see content or conduct that breaches this AUP, report it to support@platecircle.com or use our in-app report tool. We review reports and act where appropriate.

8. Consequences of breach

8.1 Where you breach this AUP, we may, at our discretion and depending on severity: remove or edit content; issue a warning; restrict, suspend or close your account; withhold or recover fees (including under the anti-circumvention clause); report you to the authorities; and take legal action.

8.2 We may act immediately and without notice where a breach is serious or where required to protect Users, third parties or the Platform.

9. Changes

9.1 We may update this AUP from time to time. The version in force is the one published on the Platform when you use it.
